Terms and Conditions of Booking

Booking Information

Your contract to provide the services of the yacht Anam Cara and her crew is with Beacon Yachting of 16 Teewell Hill, Staple Hill, Bristol BS16 5PA. On making a booking, you agree to these terms and conditions. The contract which is made on acceptance of the booking information, is based on these terms and conditions, and is subject to the jurisdiction of the English Courts. The departure date is the date of arrival on board Anam Cara.

Please check your booking information for errors and discrepancies, as this information is used to facilitate your holiday. Any errors on the booking confirmation should be notified to us within 7 days of receipt, or if the departure date is less than 14 days from the date of issue, within 24 hours. After this period, the booking confirmation is deemed to have been accepted. The contract is between the party leader and Beacon Yachting. The guest information is required to obtain navigation permits for your holiday. This can be completed by E Mail or by post, and must be completed 10 weeks prior to your departure date, or, if the departure date is less than 10 weeks after booking, within one week of your receipt of the guest information request forms. If the departure date is less than a week from the booking, the information must be supplied within 24 hours, and at least 48 hours prior to departure. If this is not possible the party leader must contact us before departure. Any delays to your holiday as a result of incomplete or inaccurate crew details are out of our control, and no compensation will be paid as a result of them. The information supplied forms part of the contract between us.

Pricing and Payments

The price of any holiday is stated in the Holiday Pricing and Passage Pricing pages, and is in Euros. These prices supersede any previous price lists, and are subject to change with out notice. Once you have paid a deposit of 50%, the price will not normally be subject to any change. Any offers and discounts available cannot be applied retrospectively. The balance of your holiday must be paid at least 10 weeks before departure. If there is less than ten weeks between the issue of your booking confirmation, and the departure date, the balance must be paid in full with the deposit.

Changes to your holiday by you

Minor changes to your holiday (e.g. the substitution of one guest for another) may be possible provided 14 days notice is given. Any requests for change must be authorised by the party leader. Any additional guests will be charged as per published prices. If, after receipt of your booking confirmation you wish to change the date or duration of your holiday, we will do our utmost to assist you. However, changes may not be possible due to other bookings. The cost of any changes will be the additional holiday cost, based on the currently prevailing brochure prices and will be subject to a 2% administration fee. Changes made within 8 weeks of departure will be treated as a cancellation and rebooking. The party leader may cancel the holiday at any time. The charge for canceling your holiday is dependent on the notice given:

  • More than 10 weeks notice: deposit only
  • 6-10 weeks notice:               50% of the total holiday cost
  • 2-6 weeks notice:                  80% of the total holiday cost
  • Less than 2 weeks notice:    100% of the total holiday cost

If the reason for cancellation is covered by your insurance policy, you may be able to reclaim any charges.

Changes to your holiday by us

We reserve the right to make changes, or to cancel your holiday as necessary. Most changes are minor, and you will be notified as soon as possible. Major changes include (but are not limited to:)

  • A change of holiday date
  • A change of holiday duration
  • A change of port base requiring a significantly extended transfer or arrival a different airport
  • Cancellation of the holiday

If we have to make a major change to your holiday, you are entitled to either accept our offer of a replacement  or to accept a full refund of the money you have paid. In all cases, excepting changes due to Force Majeure, we will compensate your party as follows:

  • More than 10 weeks notice:     €45.00 per party
  • 6-10 weeks notice:                   €90.00 per party
  • 2-6 weeks notice:                      €300.00 per party

No compensation will be paid if the change is due to Force Majeure. Force Majeure means unforeseen and unusual circumstance beyond our control, the circumstances of which could not have been avoided even if all due care is exercised. Examples are riot, civil strife, unavoidable technical problems, terrorist activity, natural disasters, fire, acute medical problems or adverse weather conditions. Please note that this list is not exhaustive.

We reserve the right in our discretion to terminate without further notice the holiday arrangements of any guest who refuses to comply with the instructions of the crew. On termination, our responsibility to you ceases, and we will not be liable for any further costs incurred.

Yachts are complex machines and technical problems can occur. Beacon Yachting will compensate clients if a yacht is disabled through no fault of the clients’ excepting cases due to Force Majeure. Compensation is based on the charter fee, less food and staffing, calculated at €500.00 per day. This covers problems with the engine, sails, mast rigging and ground tackle. If the yacht is disabled through no fault of Beacon Yachting’s, e.g damage by previous guests, we may substitute another yacht of similar size.

Insurance

Yacht sailing carries an element of risk. Participation in this activity is at your own risk. The skipper of the yacht has primary responsibility for the safety of guests and crew at all times. In the interests of safety, the skipper may change the itinerary: decide whether passages should be made, and if these should be under power or sail. Anam Cara is fully insured, including third party and public liability insurance. We do not provide travel insurance for our guests. All guests must make their own travel insurance arrangements, and ensure that this covers them for a yacht sailing holiday, and any other activities envisaged. Please note that Beacon Yachting is not responsible for delays and cancellations to flights. Please ensure that your insurance covers these eventualities. Children aboard the yacht are the sole responsibility of their parents/guardians.

Use of the dinghy assumes liability for the full cost of any damage or loss occurring during the clients use. Please be advised that this could be in excess of €5,000
